1. Parties and Scope
1. These Terms of Service (these “Terms”) are entered into between VisioSonic AI (the “Platform”, operated by the entity disclosed on the Platform website) and users of the Platform (the “User”). They govern all rights and obligations related to User access to and use of this cross-border independent website (VisioSonic AI official domain name) and related services.
2. These Terms apply to all services provided by the Platform, including product display, online transactions, payment processing, cross‑border logistics, order tracking, AI‑related services, customer support, and other ancillary services.
3. User registration, order placement, payment, or any use of the Platform constitutes User’s full reading, understanding, and acceptance of these Terms.
4. The Platform’s Privacy Policy, Return & Refund Policy, Shipping Policy, customs duty notice, promotional rules, and other policies published on the Platform are integral parts of these Terms.
2. Services
1. The Platform provides Users with services including cross‑border product information, ordering, payment, order management, logistics tracking, and after‑sales support.
2. AI‑related services (such as intelligent recommendations, image/video processing, content generation, etc.) are governed by these Terms and any applicable supplementary rules.
3. The Platform reserves the right to adjust services, features, pricing, and operations, with prior notice via website announcement, email, or in‑platform notification.
3. User Account and Obligations
1. Users must provide true, accurate, and complete identity, contact, and shipping information, and update such information promptly. Any loss due to false, incomplete, or outdated information (including order errors, delivery failure, customs clearance issues, delayed refunds) shall be borne by the User.
2. Users are responsible for the security of their account, password, and payment details. Accounts may not be transferred, lent, or used for illegal, infringing, fraudulent, or disruptive activities.
3. Users shall comply with the laws of China and the destination country/region, and shall not purchase prohibited or restricted items or infringe upon third‑party intellectual property rights, portrait rights, reputation rights, or other legal rights.
4. Users shall cooperate with the Platform, customs, logistics, and payment providers for identity verification, order declaration, customs documentation, and other required procedures.
4. Orders and Payment
1. Product prices do not include cross‑border shipping fees, import duties, VAT, or other destination taxes. All such fees are clearly displayed at checkout and are the User’s responsibility.
2. An order is formed upon successful payment. The Platform reserves the right to decline fulfillment or cancel an order before payment is completed.
3. The Platform supports compliant cross‑border payment methods including credit cards and e‑wallets. Processing fees and foreign exchange differences incurred during payment are borne by the User.
4. The Platform will assist in resolving transaction anomalies caused by payment failures, account issues, or third‑party payment errors, but shall not be liable for indirect losses.
5. Cancellations or refunds due to User reasons (change of mind, address error, refusal of delivery) after order confirmation are subject to the Platform’s Return & Refund Policy.
5. Cross‑Border Shipping and Delivery
1. The Platform will ship orders within the stated time after successful payment. Delivery times are estimates and may be affected by destination, customs efficiency, holidays, and force majeure.
2. Risk of loss or damage to goods passes to the User upon delivery (as recorded by the logistics carrier).
3. Users must inspect goods upon receipt. Any damage, missing items, or wrong items must be reported with valid evidence to customer service within 48 hours of delivery; otherwise, the goods are deemed accepted in good condition.
4. If goods are returned, destroyed, or detained due to User reasons (incomplete address, refusal, failure to clear customs, failure to provide documents), all related costs and losses shall be borne by the User.
6. Customs Duties and Clearance
1. Import duties, value‑added tax, customs clearance fees, and other destination taxes and charges are the sole responsibility of the User. The Platform does not bear, advance, or guarantee exemption from such fees.
2. Users must comply with customs regulations of the destination country and truthfully declare goods. Any fines, detention, or return due to misdeclaration or underreporting shall be borne by the User.
3. The Platform may assist with necessary customs documentation but is not liable for customs clearance failures.
7. After-Sales Service, Returns and Refunds
1. The Platform provides returns and refunds in accordance with applicable cross‑border e‑commerce rules and the VisioSonic AI Return & Refund Policy.
2. Returns and exchanges are allowed only if: goods are unused and in resalable condition; requests are made within the valid period; and valid proof is provided.
3. Return shipping due to product defects, wrong items, or missing items shall be borne by the Platform. Return shipping due to personal reasons (change of mind, size issues, address changes) shall be borne by the User.
4. Refunds will be processed via the original payment method. Processing times depend on payment providers and banks.
8. Intellectual Property
1. All intellectual property rights in the Platform content (including text, images, videos, trademarks, patents, software, AI models, UI design, databases, etc.) are owned by the Platform or its licensors.
2. Users may not copy, distribute, modify, transmit, commercially use, or infringe upon such content without prior written authorization.
3. If Users believe Platform content infringes their rights, they may submit ownership proof and contact the Platform.
9. Privacy Protection
1. The Platform collects, uses, stores, and transmits personal information in strict compliance with the Personal Information Protection Law of the People’s Republic of China, EU GDPR, and applicable privacy laws of destination countries.
2. The Platform collects information only for order fulfillment, customer service, risk control, and compliance purposes, and will not unauthorized disclose or sell User data.

10. Disclaimer
1. The Platform shall not be liable for failures or delays caused by force majeure, including natural disasters, war, policy changes, epidemics, cyberattacks, or telecommunication failures, but will use reasonable efforts to mitigate impact.
2. The Platform is not liable for losses caused by failures, errors, or violations of third‑party services (payment processors, logistics providers, customs, cloud services), but will assist in User claims.
3. The Platform does not guarantee product pricing, performance, commercial use, or profitability.
4. Losses caused by User error, device failure, password disclosure, or illegal activities shall be borne by the User.
11. Modification and Termination
1. The Platform may revise these Terms. Revised Terms will be posted on the website and take effect 7 days after publication. Continued use constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform immediately.
2. The Platform may suspend, restrict, or terminate accounts for violations and reserve the right to pursue legal action.
3. Provisions regarding intellectual property, privacy, disclaimer, and dispute resolution shall survive termination.
12. Dispute Resolution
1. These Terms are governed by the laws of the People’s Republic of China (excluding conflict of laws rules), while complying with mandatory laws of the destination country/region.
2. Any dispute shall first be resolved through good‑faith negotiation. If negotiation fails, either party may submit the dispute to the competent court where the Platform operator is located.
3. Users may contact local consumer protection or e‑commerce regulatory authorities; the Platform will cooperate in good faith.
13. General
1. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force.
2. Failure by the Platform to enforce any right shall not constitute a waiver of such right.
